Leadmaite Subscription Terms of Service

These Subscription Terms of Service (“Terms”) govern the purchase and use of Leadmaite software and services (“Leadmaite,” “the Service,” “the Platform”). By creating an account, subscribing to a plan, or using the Platform, you (“Customer,” “User”) agree to these Terms.


1. Subscription Plans

Leadmaite offers recurring subscription plans, including:

All-In-One CRM

AI Receptionist PLUS

AI Receptionist UNLIMITED

Each plan includes a specific set of features as described on the Leadmaite website. Leadmaite may introduce additional plans or modify plan features from time to time.


2. Billing Cycles

Subscriptions are billed on a monthly or annual recurring basis.

Monthly plans renew every 30 days.

Annual plans renew every 12 months and may include discounted pricing.

Your subscription will automatically renew unless canceled prior to the next renewal date.


3. Payment Authorization

By subscribing, you authorize Leadmaite to automatically charge your payment method on file for:

Subscription fees

Usage-based fees

Add-on services

Applicable taxes

You agree to maintain valid payment information at all times.


4. Refund Policy

Leadmaite subscriptions and usage-based fees are non-refundable, including:

Partial months of service

Unused features

Early cancellation

Promotional or discounted pricing

If you cancel, your subscription remains active until the end of the paid billing period.


5. Cancellation Policy

You may cancel your subscription at any time through your account dashboard or by submitting a written request to support.

Cancellation stops future billing.

No refunds or credits are issued for the remaining billing cycle.

Upon cancellation, your account may lose access to premium features, data, and automations.

Leadmaite is not responsible for data loss resulting from cancellation.


6. Account Suspension for Non-Payment

Leadmaite may suspend or terminate service if:

Payment fails

Usage fees exceed your balance

Fraud or abuse is detected

The account violates compliance requirements

Suspension may impact inbound/outbound calling, texting, AI usage, and access to the CRM.


7. Plan Changes & Upgrades

If you upgrade:

Feature access updates immediately

Subscription fees are prorated

If you downgrade:

Changes take effect at the next renewal date

Access to higher-tier features continues until the current billing period ends


8. Usage-Based Fees

Usage fees apply to:

Phone calls

SMS/MMS messages

Email sending

AI conversation processing

AI voice generation

Carrier & compliance fees

Usage rates are published on the Leadmaite website and may change due to updates from upstream carriers or AI providers.

You agree to pay all usage fees incurred under your account.


9. Compliance Requirements

Leadmaite requires compliance with:

A2P 10DLC registration

SMS carrier guidelines

Local and federal communication laws

Data protection regulations

Failure to comply may result in blocked messages or account suspension.


10. Acceptable Use & Restrictions

You agree not to use Leadmaite for:

Sending unsolicited or spam messages

Misrepresentation or fraudulent activity

Abusive calling or messaging practices

Illegal or regulated use cases (e.g., scams, adult content, hate speech)

Violating carrier, AI provider, or government regulations

Leadmaite reserves the right to review, restrict, or terminate accounts violating the Acceptable Use Policy.


11. Service Availability

Leadmaite strives for continuous service availability but does not guarantee:

Uninterrupted operations

Error-free performance

Delivery of all messages or calls

Uptime of third-party integrations

Leadmaite is not liable for outages caused by carriers, AI providers, internet infrastructure, or external platforms.


12. Data Ownership

You retain ownership of your content and customer data.
Leadmaite retains:

Rights to operate, process, and store your data for service delivery

Aggregated and anonymized data for analytics and product improvement

You are responsible for exporting your data before canceling or closing your account.


13. Modifications to Pricing & Terms

Leadmaite may update:

Subscription pricing

Usage-based rates

Plan features

Terms of Service

Updates are posted publicly and take effect on the next billing cycle unless otherwise specified.

Continued use of the Platform constitutes acceptance of updated Terms.


14. Termination of Service

Leadmaite may terminate accounts for:

Repeated payment failures

Fraudulent or abusive activity

Regulatory violations

Unauthorized system access

Misuse of AI tools or communication tools

Upon termination, access to the Platform ends immediately.


15. Limitation of Liability

To the fullest extent permitted by law:

Leadmaite is not liable for indirect, incidental, or consequential damages

Leadmaite's maximum liability is limited to the amount paid by you in the prior 3 months

Leadmaite is not responsible for lost revenue, missed communications, or business interruptions


16. Governing Law

These Terms are governed by the laws of the state in which Leadmaite is headquartered, without regard to conflict-of-law principles.


17. Acceptance of Terms

By subscribing to Leadmaite, you acknowledge that:

You have read and agree to these Terms

You are authorized to use the payment method

You understand subscription and usage-based billing will continue until canceled
